One of the first hurdles you'll encounter is understanding the legal terminology surrounding divorce and real estate. To help you, I've put together this glossary of essential terms:

Community property

Any assets or debts acquired during your marriage are generally considered community property in Florida. This includes your house, even if only one spouse is on the title. Understanding this concept is crucial when dividing property during a divorce.  

Equitable distribution

Florida is an equitable distribution state, meaning marital assets and debts are divided fairly but not necessarily equally in a divorce. A judge will consider various factors, such as each spouse's contribution to the marriage and economic circumstances, to determine a fair division of property, including your house.  

Marital home

This term simply refers to the primary residence you and your spouse shared during your marriage. It's often one of the most significant assets to be divided in a divorce.

Divorce decree

This is the final court order that legally dissolves your marriage and outlines the terms of your divorce, including the division of property, child custody, and any spousal support obligations. It will also address the sale of your house and how the proceeds will be divided.  

Real estate attorney

A real estate attorney specializing in divorce can be invaluable during this process. They can advise you on your rights and obligations regarding the sale of your house, help you understand the tax implications, and ensure your interests are protected throughout the legal proceedings.

Real estate agent

An experienced real estate agent can guide you through the process of selling your house. They can help you determine a fair market value, market your property effectively, and negotiate offers. Finding an agent who understands the unique challenges of selling a house during a divorce is essential.  

Other important terms

  • Separate property: Assets acquired before the marriage or received as gifts or inheritance during the marriage are generally considered separate property and are not subject to division in a divorce.
  • Alimony: Spousal support, also known as alimony, may be awarded by the court to one spouse to help them maintain their standard of living after the divorce.
